The petitioner seeks bail in S.T. No.342 of 2017 arising out of Noor Sarai P.S. case No.63 of 2016 registered under Sections 302/34 of the Indian Penal Code, pending in the court of 3rd Additional District and Sessions Judge, Nalanda, Bihar Sharif.

The earlier bail application of the petitioner was rejected vide Annexure 1 to the present application taking into account that the petitioner brutally assaulted the son of the informant and son of the informant succumbed to the injuries. A report was called for from the court below regarding the stage of trial. It has been reported that only the doctor is to be examined in the present case and the trial is

Patna High Court CR. MISC. No.10349 of 2019(3) dt.18-07-2019 2/2 expected to be concluded within a period of six months. Considering the nature of accusation and the stage of the trial, I am not inclined to grant bail to the petitioner. The same is rejected.

The Trial Court is directed to take all necessary steps to conclude the trial at the earliest preferably within a period of six months from the date of receipt/production of a copy of this order.
