JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is languishing in custody since 25.8.2014 in a case registered for the offences punishable under Sections 419,420,467,468,471 and 120B of the Indian Penal Code and section 25(1-B)a and 26 of the Arms Act.
It is alleged that the petitioner's arms lincence was issued from Jamshedpur for which subsequent entry was made in the district of Rohtas but it was found that the licence was forged and fake.
It is submitted by the learned counsel for the petitioner that the petitioner got licence in 1979 on the basis of which he purchased arms in 1996. In 2003 the petitioner was involved in some criminal case and surrendered his arms which was released in 2011 and till 2011 the arms licence was renewed regularly. Statement has been made in paragraph 3 of the petition that the
Patna High Court Cr.Misc. No.116 of 2015 (2) dt.07-01-2015 2/2 petitioner has no criminal antecedent.
Considering the fact that the genuineness of the arms licence has been questioned by the authorities after about three decades, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Rohtas at Sasaram in connection with Kargahar (Sirhdi) P.S. Case No. 185 of 2013.
