Although time was granted to the learned State counsel to seek instructions and file counter affidavit but he shows helplessness in absence of the instruction.
The writ petition is filed for the direction to the respondent authorities including the District Magistrate, Vaishali to regularize the service of the petitioner on any Class IV post. It is the case of the petitioner that he worked on daily wage basis in the Vaishali Collectorate since 30.11.1987 until the date. It is also his case that although a selection process was initiated and the name of the petitioner was in consideration for regular appointment as manifest from the letter of the District Magistrate present at Annexure-3 but since it was not forthcoming he along with some
Patna High Court CWJC No.1055 of 2016 (3) dt.16-08-2017 2/2 others came before this Court in C.W.J.C.No.579 of 2005 for regularization of services and which writ petition was disposed of on 4.12.2006 with the direction present at paragraph 9 of the writ petition.
It is the grievance of the petitioner that the respondents have not taken any steps to constitute Committee in the light of the judgment dated 4.12.2006, a copy of which is present at Annexure-5. It is further the case of the petitioner that panel for recruitment was prepared by the District Magistrate on 26.3.2010, a copy of which is present at Annexure-6 and which contains the name of the petitioner at Serial No.32. It is stated that when relief was not forthcoming that the petitioner represented before the District Magistrate, Vaishali for his regularization on 7.8.2015 but which has remained pending.
Having heard learned counsel for the parties and in the nature of the relief prayed, I deem it proper to dispose of the writ petition with the direction to the District Magistrate, Vaishali to consider the grievance of the petitioner and dispose of the same in accordance with law bearing reference to his representation present at Annexure-7 expeditiously and preferably within 3 months from the date of receipt/production of a copy of this order.
