JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 22-02-2016 Heard learned counsel for the petitioner and the learned counsel representing the State.

The petitioner wants to renew his prayer of bail which was earlier rejected vide order dated 22.04.2015 passed in Criminal Misc. No. 9669 of 2015 on the ground that the petitioner is in custody since 28.10.2014, in near future the trial is not likely to be concluded which is evident from the report of learned Sessions Judge dated 11.02.2016, other two accused are on bail and, as such, the petitioner also deserves sympathetic consideration, to which the learned A.P.P. opposes. In the facts and circumstances stated above, considering the recovery of 34 Kg. of Ganja from possession of the petitioner, at this stage this Court is not inclined to enlarge him

Patna High Court Cr.Misc. No.52238 of 2015 (3) dt.22-02-2016 on bail and again prayer of bail of the petitioner stands rejected. However, the trial court is directed to expedite the trial and conclude the same within six months after receipt or production of a copy of this order, failing which, the petitioner may be at liberty to renew his prayer for bail in learned court below itself who shall give reason as to why the trial could not be concluded within the said period.
