JUSTICE RAKESH KUMAR ORAL ORDER 01-12-2015 Heard Sri Gajanan Mishra, learned counsel for the petitioner and learned Addl. Public Prosecutor. The petitioner, who is in custody since 31.05.2015 in Alamganj P.S. Case no.133 of 2014 registered for the offence under Section 307 and other allied Sections of the Indian Penal Code and Section 27 of the Arms Act, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that due to family dispute, the petitioner has been implicated in this case. It has been argued that injury was not caused by the petitioner, but the informant side themselves had sustained injury by their own arms. On the aforesaid ground, learned counsel for the petitioner has prayed for bail.

Learned Addl. Public Prosecutor has opposed the

Patna High Court Cr.Misc. No.52077 of 2015 (2) dt.01-12-2015 2/2 prayer for bail of the petitioner. He submits that in the F.I.R. there is specific allegation against the petitioner that he fired on the son of the informant and F.I.R. was recorded in P.M.C.H.,Patna. Keeping in view nature of accusation, I do not find any ground to extend the privilege of bail to the petitioner. The petition stands dismissed.
