JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 06-02-2020 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Rail Saharsa P.S. Case No. 25 of 2019 (S.T. No. 334 of 2019) for the offenses under Section 395 of the Indian Penal Code. Allegation against the petitioner is that he was involved in loot of mobile phone and purse containing Rs. 9000/-.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. The petitioner is in custody since 4.11.2019. The petitioner was not named in the FIR.

Considering the fact that the petitioner has no criminal antecedent and he was not named in the FIR, let the
