Perused the impugned order dated 27.07.2016 passed by learned Munsif-III, Patna in Eviction Suit No.43 of 2015 whereby the court below directed the petitioner to pay rent to the plaintiff at the rate of Rs.5,000/- per month in exercise of jurisdiction under Section 15 of the Bihar Building (Lease, Rent and Eviction) Control Act.

The only grievance of the petitioner is that instead of paying rent to the plaintiff he may be permitted to deposit the rent in the Court.

In view of the submission of the learned counsel for the petitioner, the petitioner is permitted to deposit the rent as directed by the court below in the suit before the court itself. With this modification in the impugned order, this civil miscellaneous application is disposed of.

Patna High Court C.Misc. No.1013 of 2016 (2) dt.28-10-2016 If the amount is deposited by the tenant in the court below, the same shall be withdrawn by the plaintiff. (Mungeshwar Sahoo, J) Harish/- U
