JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 02-03-2020 Heard learned counsel for the petitioner and learned Additional Public Prosecutor appearing on behalf of the State. The petitioner is apprehending arrest in connection with Pipra P.S. Case No. 230 of 2019 for offences under Sections 399 and 402 of the Indian Penal Code and Sections 25(1-b)a, 26 and 35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has no criminal antecedent. From the first information report, it would be evident that the petitioner himself is a victim and is not a person who made firing upon anyone. In fact, the petitioner has sustained firearm injury.

Considering the fact that there is no allegation of using firearm by the petitioner rather he himself sustained firearm injuries, this Court is inclined to grant bail to him. Let

No. 8118 of 2020(2) dt.02-03-2020 2/2 petitioner, above-named, in the event of arrest or surrender within one month from today, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of 11th Additional Chief Judicial Magistrate, Motihari, East Champaran in connection with Pipra P.S. Case No. 230 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
