2. The petitioner seeks regular bail in connection with Amarpur P.S. Case No. 628 of 2024, registered for the offence punishable under Sections 25(1-b), 26, 35 of the Arms Act.

3. As per prosecution, there is recovery of two live cartridges from the possession of the petitioner.

4. Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. Petitioner has clean antecedent and he is in custody since 14.09.2024.

5. Learned APP has vehemently opposed the prayer for bail.

6. Considering the aforesaid fact and also period of custody, this application is allowed.

7. Let the petitioner, above named, be released on bail

Patna High Court CR. MISC. No.9869 of 2025(2) dt.06-03-2025 2/2 on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka/concerned court, in connection with Amarpur P.S. Case No. 628 of 2024, with a condition that:

(I) The court below will verify the criminal antecedent of the petitioner and if it is found that the petitioner has any criminal antecedent, the bail bond of the petitioner shall not be accepted and if it is found that petitioner has clean antecedent, his bail bond shall be accepted.
