2. The petitioners seek bail in connection with Alinagar P.S. Case No. 77 of 2024 instituted for the offences punishable under Sections 457 and 380 of the Indian Penal Code.
3. As per the prosecution case, the theft was committed in the house of informant's neighbor namely Pankaj Kumar Jha. The thief took away golden ornaments worth Rs. 2,00,000/-.
4. Learned counsel for the petitioners submits that the petitioners are innocent and have committed no offence and
Patna High Court CR. MISC. No.10707 of 2025(3) dt.12-05-2025 2/3 have falsely been implicated in this case. He submits that except the confessional statement of co-accused persons and confession made by these petitioners there is no evidence against the petitioners. He further submits that neither any articles has been recovered from the conscious possession of the petitioners nor from their house. He next submits that petitioners are not named in the FIR. He lastly submits that the petitioners have been implicated in this case at the instance of police. Petitioners are in custody since 07.09.2024.
5. Learned APP opposes the prayer for bail.

From perusal of the case diary, FIR and impugned order of the learned Sessions Judge, Camp Court, Benipur, Darbhanga dated 08.01.2024, it appears that petitioners are not named in the FIR and his name transpired in this case during the course of investigation. From perusal of the records, it appears that on the basis of written report of the informant Radha Devi, FIR has been lodged under Sections 457 and 380 of the Indian Penal Code against unknown persons. During investigation the name of the petitioners have been surfaced on the basis of confessional statement of other co-accused and no recovery have been made from the conscious possession of the petitioners. Investigation has already been concluded and
Patna High Court CR. MISC. No.10707 of 2025(3) dt.12-05-2025 3/3 chargesheet has been submitted during investigation but no Test Identification Parade has been conducted till date, so consdiering all the aspects of the matter, I am inclined to grant bail to the petitioners.
7. Accordingly, the prayer for bail of the petitioners are allowed. Let the petitioners above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned A.C.J.M.-I, Benipur at Darbhanga in connection with Alinagar P.S. Case No. 77 of 2024.
