JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 25-04-2023 Heard learned counsel for the petitioner and the State. The petitioner apprehends arrest in a case registered for the offence punishable under sections 399/402/414 of the Indian Penal Code and sections 25(1-B)a, 26 and 35 of the Arms Act.

On a secret information that some criminals have assembled to commit crime a raid was conducted and three accused persons were apprehended on the spot. Learned counsel for the petitioner submits that the petitioner is a student. His name has figured during course of investigation in confessional statement of co-accused. No incriminating material has been recovered from the conscious possession of the petitioner. Petitioner has got no criminal antecedent. Similarly situated co-accused has already been allowed pre-arrest bail by this Court vide order passed in

Patna High Court CR. MISC. No.10168 of 2023(2) dt.25-04-2023 2/2 Cr.Mis.No. 35936/2022.

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner mentioned above be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, West Champaran, Bettiah in Majhaulia Police Station Case No. 129 of 2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
