JUSTICE JITENDRA MOHAN SHARMA ORAL ORDER 09-02-2016 Heard learned counsel for the petitioner and learned Additional Public Prosecutor representing the State. The petitioner seeks bail in connection with Tatarpur (Vishwavidhyala) P.S. case No. 87/2015 registered for the offences punishable under sections 25(1-b) a, 26 and 35 of the Arms Act.

The report has been received from the court of learned Chief Judicial Magistrate, Bhagalpur wherein it has been stated that for argument of defence the next date is 10.02.2016 and thereafter the judgement will be pronounced.

In view of allegation, as made in the self statement of the informant, and further, the criminal antecedent of the petitioner and also considering the report, as stated above, at present this

Patna High Court Cr.Misc. No.53523 of 2015 (4) dt.09-02-2016 2/2 court is not inclined to enlarge the petitioner on bail and, accordingly, such prayer stands rejected. However, if the trial is not concluded within one month from today, without any fault of the petitioner, then the petitioner may renew his prayer for bail. This Cr. Misc. stands disposed of.
