Mr. Ajit Kumar, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE PURNENDU SINGH ORAL ORDER 28-03-2025 Heard Mr. Tilak Sao, learned counsel appearing on behalf of the petitioner and Mr. Ajit Kumar, learned APP appearing on behalf of the State.

2. The petitioner apprehends his arrest in connection with Alamganj P.S. Case No. 870 of 2024 registered under Section 30(a) of Bihar (Prohibition) Excise Act, 2016.

3. The allegation is of recovery of 88.35 liters of foreign liquor from a community hall namely Jaiswal community hall. The petitioner has been alleged to be the manager/ care taker of the said community hall.

4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and he has falsely been implicated in the present case. He has no concern either with the seized liquor which was made from the said community

5. Learned APP for the State has vehemently opposed the prayer for grant of pre-arrest bail to the petitioner.

6. In the facts and circumstances of the case, as well as, the fact that the petitioner has not denied the fact that he is not the manager of the community hall namely Jaiswal community hall from where huge quantity of liquor was recovered. In absence of denial on behalf of the petitioner that he is not connected to the said community hall in any manner, from where illicit liquor has been recover, I don't find that the petitioner has made out case to be released on pre-arrest bail.

7. Accordingly, the present bail application stands disposed of.
