JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 21-05-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 302/324/34 of the Indian Penal Code.

Petitioner and two other FIR named accused are said to have assaulted the deceased by means of lathi. The postmortem report goes to show that one injury was found on the head of the deceased whereas another superficial injury was found on his forehead. Moreover, having more or less similar allegation, co-accused Ishwar Tanti has already been granted privilege of bail by co-ordinate bench of this court vide order dated 07.05.2019 passed in Cr. Misc. No. 12357 of 2019.
