JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 05-05-2022 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Bahadurganj P.S. Case No. 298 of 2021, registered for the offence punishable under Section 392 of the Indian Penal Code and section 27 of the Arms Act. Later on sections 395, 412 of the Indian Penal Code and section 25(1-b)a of the Arms Act.

As per the prosecution case, 2193 Grams of silver ornaments was recovered from possession of this petitioner. It is submitted on behalf of the petitioner that petitioner is not named in the FIR. No looted article has been recovered from possession of this petitioner. The seized silver ornaments is not part of the looted article, as the same has not been put on test identification parade and the same belongs to

Patna High Court CR. MISC. No.10110 of 2022(3) dt.05-05-2022 2/2 family of the petitioner. Petitioner has not been put on test identification parade till date. Petitioner claims clean antecedent and is in custody since 18.11.2021 and investigation in this case is complete.

Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kishanganj in connection with Bahadurganj P.S. Case No. 298 of 2021.
