2. The present writ petition has been filed for seeking following reliefs:
"i) For issuance of writ in the nature of certiorari for quashing the letter bearing Memo No.3108 dated 13.12.2023 by which suspended to petitioner for contemplation of departmental proceeding.
ii) For further issue direction to the respondents for vacate the order of suspension. (iii) For further give other legal consequential benefit to the petitioner to the post."
3. Learned counsel for the petitioner submits that the
Patna High Court CWJC No.3111 of 2024(4) dt.02-04-2025 2/2 suspension of the petitioner has been revoked but the subsistence allowance has not been paid to the petitioner.
4. Considering the relief sought by the petitioner, the petitioner is directed to file a detailed representation before the respondent no.6 along with all supporting documents within a period of four weeks and the respondent no.6 is well advised to consider the case of the petitioner after affording opportunity of personal hearing or through his counsel and pass a reasoned and speaking order in accordance with law within one month thereafter.
5. If the petitioner is found entitled to subsistence allowance, then the payment of the same shall be made to the petitioner within two months thereafter.
6. With the aforesaid direction, the writ application stands disposed of.
