The petitioners are apprehending their arrest in a case registered for the offence punishable under Sections 272, 273 of the Indian Penal Code and Section 47(A) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioners submits that there is recovery of 60 litres of country made liquor from the shop of the petitioner no. 1 and 12 litres of foreign liquor from the house of the petitioner no. 2 which is joint family property. He further submits that petitioners have no criminal antecedent as stated in para-3 of the bail petition.

However, petitioner is agreed to deposit Rs. 25,000/-

Patna High Court CR. MISC. No.9225 of 2020(2) dt.29-02-2020 2/2 in the Juvenile Justice Fund of the State Social Welfare Department.

In the facts and circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of six weeks from the date of receipt of the order, be released on anticipatory bail on furnishing bail bond of Rs.20,000/- (rupees twenty thousand) each with two sureties of the like amount each to the satisfaction of the learned Special Judge Excise, Gaya in connection with Barachatti Police Station Case No. 160 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
