Petitioner apprehends his arrest in connection with Complaint Case No. 155C of 2017 registered for the offence punishable under Sections 498(A) of the Indian Penal Code and Section 3/4 of D.P. Act.

Petitioner, who happens to be husband of the complainant (O.P. No. 2) is said to have tormented her over dowry demand in association of his family members. It is submitted by learned counsel for the petitioner that the petitioner has neither made any dowry demand nor ever tormented the complainant over the same. Petitioner is always

No.9589 of 2019(5) dt.18-06-2019 2/2 willing to keep the complainant with him with full honour and dignity and for the said cause, he has filed Matrimonail Case No. 37 of 2018 in the Family Court, Deoghar. The petitioner has been falsely implicated in this case due to ulterior motive. The petitioner has no criminal antecedent.

Notice was sent to the O.P. No. 2 (complainant) by the Court, but despite taking notice, she did not turn up before the Court.

In the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Barh, District-Patna in connection with Complaint Case No. 155C of 2017, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
