JUSTICE DINESH KUMAR SINGH ORAL ORDER 13-01-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 307/34 of the Indian Penal Code and section 27 of the Arms Act.
The prosecution case is that all the accused persons including the petitioner came to the house of the informant in the night when co accused Kamlesh yadav shot fire at the informant causing fire arm injury to him. The accused persons threatened the informant to kill the entire family. Motive of the occurrence is some quarrel between the informant and Sudarshan Bind.
It is submitted by the learned counsel for the petitioner that no overt act has been alleged against the petitioner and
Patna High Court Cr.Misc. No.1628 of 2016 (2) dt.13-01-2016 2/2 statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. It is further submitted that co accused Sudarshan Bind has been granted anticipatory bail vide Cr. Misc. No. 51685 of 2015.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Kaimur at Bhabua in connection with Chainpur P.S. Case No. 172 of 2015 subject to the conditions as laid down under Section 438(2) Cr.P.C.
