The petitioner seeks regular bail in Parbatta P.S. Case No. 35 of 2014 for the offence under Sections 366 and other section of the Indian Penal Code.

The father of the victim made allegation that one Surjit Yadav kidnapped the victim girl.

Learned counsel for the petitioner submits that the petitioner is alleged to have kidnapped the victim girl but now the case is compromised between the parties.

Patna High Court Cr.Misc. No.883 of 2015 (2) dt.12-01-2015 2/2 It appears that on recovery of the victim girl, the doctor has assessed her age 15-16 years. The victim girl in her statement under Section 164 Cr.P.C. stated that it was he, who kidnapped her and committed rape with her.

Considering the facts and circumstances of the case, I am not inclined to grant bail to the petitioner at this stage. Accordingly, the same is rejected.
