JUSTICE DINESH KUMAR SINGH ORAL ORDER 28-01-2016 Petitioners are apprehending their arrest in a case registered for the offences punishable under Sections 147, 341, 427, 379, 353, 504 of the Indian Penal Code. The prosecution case is that the petitioners obstructed the informant in getting Angan Bari Centre constructed and taken away the construction materials. It is submitted by learned counsel for the petitioners that construction was going on in the part of the road which was protested by the petitioners for which a report was called from the Circle Officer also. Hence, the present case with malicious accusation has been levelled.

Patna High Court Cr.Misc. No.4024 of 2016 (2) dt.28-01-2016 2/2 A statement has been made in para 3 of the petition that petitioners have no criminal antecedent. Considering the accusation being omnibus and general and the fact that petitioners have no criminal antecedent, let the petitioners, above named, in the event of their arrest or surrender before the Court below within a period of 12 weeks from today, be released on provisional anticipatory bail for six months on furnishing bail bond of Rs. 10,000/-(ten thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Judge-IV, Motihari, East Champaran in connection with Madhuban P.S. Case No. 62 of 2015, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.

The provisional bail of the petitioners will be confirmed by learned Court below on taking report from the concerned police station that petitioners are in no way interfering with any government scheme in the area. (Dinesh Kumar Singh, J) Shageer/- U T
