JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 05-05-2023 Heard learned counsel for the petitioner and learned A.P.P appearing on behalf of the State. The petitioner is languishing in custody in a case registered for the offences punishable under Sections 341, 323, 324, 307, 504, 506 of the Indian Penal Code.

It is alleged against the petitioner that he assaulted with Pasuli, a sharp edge weapon on the neck of the informant but it hit the hand of the informant and he sustained several injuries on his hand.

It is submitted by learned counsel for the petitioner that petitioner is innocent and he has falsely

The petitioner and informant are next door neighbour and in the background of a petty dispute, the present accusation has been levelled against him. The petitioner is old person aged about 69 years. The petitioner is languishing in custody since 20.09.2022. A statement has been made in para 3 of the petition that petitioner has no criminal antecedent.

Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, VI, Gaya in connection with Tikari P.S. Case No. 578 of 2022.
