The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 147,148,149,458,354,323,307,504,395 and 397 of the Indian Penal Code.

The accusation is that the petitioners came variously armed, whereafter on the order of petitioner no. 1, petitioner no. 2 fired on the head of the informant, thereafter accused persons entered into the house of the informant when petitioner nos. 1 and 2 abused and misbehaved the wife of the informant and took away house

Patna High Court Cr.Misc. No.53210 of 2015 (2) dt.23-11-2015 2/3 hold articles. Petitioner no. 3 took away a box containing clothes, jewellery and cash of rupees one lac fifty thousand and petitioner no. 4 took away C.D. machine whereas the accused persons took away diesel pump of 5 horse power. It is submitted by the learned counsel for the petitioners that for the occurrence of 31.8.2015 the complaint was filed on 2.9.2015 which came to be registered as police case on 2.10.2015. It is further submitted that petitioner Mamta Kumari lodged Lakhisarai P.S. Case No. 585 of 2015 levelling accusation under sections 341,342,323,354 and 504/34 IPC against the informant side. Statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent and they belong to one family.

Considering the case lodged by the petitioners side at earlier point of time and the petitioner having no criminal antecedent, let the above named petitioners be released on anticipatory bail in the event of arrest or surrender before the learned Court below within a period of twelve weeks from today on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM,
