The petitioner, Sunil Kumar Singh, who is in custody in Bishanpur P.S. Case No. 14 of 2015 under Section 302/34 of I.P.C.
Learned counsel for the petitioner submitted that the petitioner is the husband of the deceased. Only on suspicion, the F.I.R. was lodged against this petitioner. In fact, the deceased i.e. wife of the petitioner was mentally ill and was being treated by the psychiatrist and she herself committed suicide. The daughter of the petitioner, who is aged about 12 years has fully supported the case that the wife of the petitioner suo-motu suicide. According to the learned counsel, charge sheet has

Learned A.P.P. appearing on behalf of the State did not dispute this fact that charge sheet has been submitted under Section 306 of the I.P.C. and the statement of the daughter aged about 12 years has been recorded in paragraph-49 of the case diary.

In view of the fact, that police found the case to be suicidal death and charge sheet has been submitted under Section 306 of the I.P.C., I direct that the petitioner named above be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Additional Sessions Judge, Darbhanga in connection with Bishanpur P.S. Case No. 14 of 2015.
