JUSTICE CHAKRADHARI SHARAN SINGH ORAL ORDER 27-06-2018 The name of the Vice Chancellor of Magadh University, Bodh Gaya appears to have been mis-spelt in the order, dated 20.06.2018, inasmuch as in place of 'Mr. Qamar Ahsan' it has been typed as 'Mr. Kamal Hasan'. Let the same be read accordingly.

Let necessary corrections be made in the order dated 20.06.2018.

Show-cause replies have been filed on behalf of the Vice Chancellor, Pro Vice Chancellor, Examination Controller and Registrar of the Magadh University. Common stand which has been taken on their behalf is that the results of some of the students of unaffiliated colleges have been mistakenly published, despite this Court's order dated 26.02.2018. It has also been stated that remedial measures have been taken with

Patna High Court MJC No.2087 of 2018(11) dt.27-06-2018 2/2 issuance of communique/notice in news-paper in this regard, copies of which have been brought on record by way of Annexures.

The contemnors have tenderedt unqualified apology. Mr. P. N. Shahi, learned senior counsel, appearing on behalf of the contemnors, has submitted that it had never been their intention to wilfully defy the Court's order. He contends that because of mistake and oversight, results were uploaded on the website of the Magadh University and that the results of such candidates have been withheld.

In view of the submissions made by Mr. P. N. Shahi, learned senior counsel, appearing on behalf of the contemnors and I am of the view, that the contemnors have been able to make out a case that it was inadvertent mistake on their part which resulted in the results being uploaded on the website of the University. No intention can be attributed to the said mistake.

The proceeding initiated against the contemnors stands dropped.
