17-12-2015 Heard Sri Anil Prasad Singh, learned counsel for the petitioner and learned Addl. Public Prosecutor. The petitioner, who is in custody since 24-09-2015 in Bounsi P.S. Case No. 108 of 2015 registered for the offence under Section 392 of the Indian Penal Code, has prayed for grant of bail. It was submitted by learned counsel for the petitioner that in this case, on perusal of the F.I.R., it is evident that occurrence had taken place on 22nd September, 2015 and it has also been shown that it was registered on 22-09-2015, whereas, on perusal of page 11 i.e. 1st page of the F.I.R., it is evident that same was received in the court of learned Chief Judicial Magistrate on 24-09-2015. He has also doubted that being illiterate lady, it was difficult for her to note down the number of motorcycle and
Patna High Court Cr.Misc. No.55352 of 2015 (2) dt.17-12-2015 2/2 model. He further submits that the petitioner is having clean antecedent, which is mentioned in paragraph - 3 of the present petition.
Keeping in view the clean antecedent of the petitioner as well as the fact that the petitioner has not been put on T.I.Parade, let the petitioner namely Amit Kumar be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Manoj Kumar, J.M. 1st Class, Araria/concerned court in connection with Bounsi P.S.
