The matter is being heard through video conferencing due to circumstances prevailing on account of Covid-19 pandemic.
Heard learned counsel for the petitioner and learned APP for the State.
The petitioner apprehends his arrest in connection with Matihani P.S. Case No.62 of 2021 registered for offences under Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act.
It is alleged in the FIR that the police got information that the petitioner was dealing in illicit liquor and kept it in the
Patna High Court CR. MISC. No.10056 of 2022(2) dt.01-04-2022 2/2 field of one Binod Singh. The illicit liquor was recovered from the place of occurrence but no one is said to have stated that it is the petitioner who was the owner of illicit liquor. Considering the aforesaid facts, this application for anticipatory bail is alllowed.
Accordingly, let petitioner, above-named, in the event of his arrest or surrender within four weeks from today, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-II, Begusarai in connection with Matihani P.S. Case No.62 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Sandeep Kumar, J) BT/- U T
