The petitioner is accused in connection with Town P.S. Case No.276/2015 registered under Sections 413 and 414 of the Indian Penal Code.
The accusation is that police received secret information about keeping the theft motorcycle by a person near Red Cross Building, Muzaffarpur and police reached there, where the petitioner was found standing near the motorcycle bearing registration no.DL65P5715. On query, the said person disclosed his name as Raushan Kumar and told that the said motorcycle was handed over by one Rahul Kumar.
Learned counsel for the petitioner submits the petitioner
Patna High Court Cr.Misc. No.53151 of 2015 (3) dt.15-02-2016 has been apprehended by the police merely on suspicion. In fact, the petitioner was moving nearby the place of occurrence and the police on suspicion apprehended him. It is further submitted that the petitioner has no criminal antecedent and he is in custody since 16.04.2015.
Having regard to the facts and circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Muzaffarpur, in connection with Town P.S. Case No. 276/2015. Out of two sureties, one surety must be the close relative of the petitioner. (Rajendra Kumar Mishra, J.) Amit/- U T
