Mr.Madhukar Mishra AC to SC-16 ====================================================== CORAM: HONOURABLE MR. JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 18-07-2019 The grievance of the petitioner in the present writ petition is non-payment of salary for the period from March, 2018 onward.
Learned counsel for the petitioner submits that the petitioner has been regularly working but she has not been paid salary regularly.
Taking work and denying salary amounts to Beggari which is violative of Article 23 of the Constitution. Considering the claim of the petitioner that she has been regularly working but not paid salary, the writ petition is
Patna High Court CWJC No.13863 of 2018(2) dt.18-07-2019 2/2 disposed of with a direction to the respondents to ascertain whether the petitioner has worked for the period she is claiming salary or not. In the event, after verification, the District Programme Officer, comes to the conclusion that the petitioner has actually worked, he shall ensure payment of salary to the petitioner at the earliest preferably within a maximum period of 60 days from the date of receipt/production of a copy of this order.
With the aforesaid, the writ petition stands disposed of.
