JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 02-12-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 20.08.2015 in a case registered for the offences punishable under Section 307 and other minor sections of the Indian Penal Code. Although, petitioner is named in the first information report but an omnibus allegation of assault has been levelled against the petitioner and several other persons. Learned counsel for the petitioner submits that several co-accused have already been granted privilege of bail but so far as petitioner is concerned, he was not aware about the institution of the present case and as a matter of fact he was

Patna High Court Cr.Misc. No.54113 of 2015 (2) dt.02-12-2015 2/2 residing in West Bengal at the time of alleged occurrence and when he came to his home, he learnt about the institution of this case and when was going to surrender before the court below, he was caught by the police. It is also informed on behalf of the petitioner that informant has sustained simple injury. Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Hilsa, Nalanda in connection with Islampur P.S. Case No. 127 of 2003, subject to condition that one of the sureties must be close relative of the petitioner.
