JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 22-02-2019 Heard learned counsel for the petitioner and learned learned Additional Public Prosecutor for the State. The petitioner is in custody in connection with Town (Motihari) P.S. Case No. 446 of 2018 for the offenses under Section 379 of the Indian Penal Code.

Learned counsel for the petitioner submits that only because of the past record, the petitioner has been made accused in the instant case. The FIR was lodged against unknown. The name of the petitioner has surfaced subsequently on account of his past track of record. The petitioner is in custody since 14.08.2018.

Considering the fact that the petitioner has remained in custody for more than six months, let the petitioner, above
