Let the defect (s), as pointed out by the office, be removed within a period of four weeks form today. The petitioner seeks bail in connection with a case registered for the offences punishable under Sections 30(a) of the Bihar Excise and Prohibition Act, 2016.

The prosecution case, in short, is that there is recovery of 393.8 liters countrymade liquor from a van bearing Registration No. BR-13C-5404, which was parked on the road side in front of the house of the petitioner.

Learned Counsel for the petitioner submits that the petitioner is innocent and he has been falsely implicated in this

It is further submitted that the recovery of the said liquor from a Maruti Van on the road side, which does not belong to the petitioner and he has no concern with the alleged recovery of liquor and vehicle. The petitioner is in custody since 01.12.2021, charge-sheet has been submitted in this case and has clean antecedent.

Learned A.P.P for the State opposes the prayer for regular bail of the petitioner.

Considering the facts and circumstances of this case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) only with two sureties of the like amount each to the satisfaction of the learned Additional District and Sessions Judge-IInd-cumSpecial Judge, Excise Court, Siwan in connection with Andar P.S. Case No. 182 of 2021.
