JUSTICE DINESH KUMAR SINGH ORAL ORDER 07-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 457 and 354B of the Indian Penal Code and Section 3 (I) (XI)(XII) of the SC/ST (Prevention of Atrocities) Act.

The accusation is of entering into the house of the informant and pulling her saree.

It is submitted by learned counsel for the petitioner that there was some altercation between the petitioner and the informant prior to the lodging of the case, hence as a retaliatory measure, the present case has been lodged.

Considering the nature of accusation, it is a case for consideration of regular bail.

Let the learned court below consider the regular bail of

Patna High Court Cr.Misc. No.168 of 2015 (2) dt.07-01-2015 the petitioner if he surrenders within a period of six weeks in connection with Sabour (Goradih) P.S. Case No. 276 of 2014 pending in the court of learned J.M., Bhagalupr. Accordingly, the application is disposed of.
