The petitioner seeks bail in a case registered under Sections 364, 397/34 of the Indian Penal Code. Later on Section 302 has been added.

Allegation is that the son of the informant sent his scorpio vehicle along with a driver for picking up the customer and conveying him to Muzaffarpur Hospital. Thereafter the vehicle and the driver went missing.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 31.05.2018 and has got no criminal antecedent. Charge sheet has been submitted in this case. There is no allegation of tampering of witnesses alleged

Patna High Court CR. MISC. No.9363 of 2019(3) dt.30-04-2019 2/2 against the petitioner. The petitioner is not named in the F.I.R. His name has come on the confessional statement of co-accused. Except for this, there is no other substantive evidence to suggest his implication in the present case. There is no eye witness to the alleged occurrence. Other co-accused has been granted bail vide Annexure 2 to the present application.

On behalf of the State, it is submitted that the petitioner is not named in the F.I.R.

Considering the aforesaid facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 4th Additional Sessions Judge, Darbhanga in connection with Laheriasarai P.S. case No.276 of 2018 corresponding to C.R.I. No.1565 of 2018 giving rise to S.T. case No.465 of 2018.
