JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 08-01-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 12.09.2014 in a case registered for the offences punishable under Sections 341, 323, 376, 380, 504, 511/34 of the Indian Penal Code and 3 (i) (x) (xii) of S.C./S.T. (Prevention of Atrocities) Act.

Admittedly, the present case was lodged on 03.07.2014 for the occurrence which had taken place on 31.03.2014 and no plausible explanation of the aforesaid long delay has been given in the first information report. It would further appear from the materials available on the record as well as submissions of the parties that prior to institution of the present case there was strained relation between petitioner and informant. Considering the aforesaid facts and circumstances as
