JUSTICE VINOD KUMAR SINHA ORAL ORDER 13-02-2019 The petitioner seeks regular bail in connection with Special Case No. 8888/2018, arising out of Sultanganj P.S. Case No. 266 of 2018, registered for offences punishable under Sections 37(a), (b) and (c) of Bihar Prohibition and Excise Act and Section and Section 25(1-b)a, 26, 35 of the Arms Act. Earlier the prayer for bail of the petitioner was disposed of vide order dated 6.12.2018 passed in Cr. Misc. No. 70127 of 2018 with liberty to the petitioner that he may renew his prayer for bail once charge is framed or he completes five months period in custody.

Submission of learned counsel for the petitioner is that now charge has been framed and petitioner has been in judicial custody since 22.09.2018.

Having heard both sides, in view of the above facts, let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Special Case No. 8888/2018, arising out of Sultanganj P.S. Case No. 266 of 2018, subject to the condition that petitioner will cooperate in disposal of trial and make himself available as and when required by the court below, failing which, the prosecution shall move for cancellation of his bail bonds (Vinod Kumar Sinha, J) sunilkumar/- U T
