The petitioner seeks bail in Saraiya P.S. Case No. 316 of 2014 for the offence under Sections 379/411 of the Indian Penal Code.

Navin Kumar lodged a case of theft of his motorcycle bearing registration no. BR 06P 5971. The petitioner is not named in the F.I.R. The petitioner was apprehended on the same day and the stolen motorcycle was recovered from his possession. Learned counsel for the petitioner submits that the petitioner is in jail for about five months and he has got no criminal antecedent.

Considering the nature of allegation and the fact that the petitioner is in jail for more than 41⁄2 months and he has got no criminal antecedent, the petitioner named above is directed to be
