The name of petitioner came in this case in confessional statement of co-accused, Manoj Tiwary, from whose shop, the alleged recovery was made and except the aforesaid material as well as criminal antecedent of the petitioner, there appears to be nothing against him.

Accordingly, petitioner named above, is directed to be released on bail on furnishing bail bond of Rs 10,000/- (ten thousand) with two sureties of the like amount each in connection with Motihari Muffasil P.S. Case No. 56 of 2010 to the satisfaction of learned Sub Divisional Judicial Magistrate, Sadar, Motihari, East Champaran.
