2. The petitioner seeks bail in connection with Birpur P.S. Case No. 179 of 2024 registered for the offence under Section 191(2), 190, 115(2), 127(2), 103(1) of the BNS.

3. As per the prosecution case, the petitioner and others assaulted two thieves who were caught while stealing goat.

4. It has been submitted by the learned counsel for the petitioner that no offence under Section 302 is made out as there is no intention to commit murder and because of excessive beating by a large number of persons, one thief died.

5. The petitioner is in jail since 7.9.2024.

6. Considering the aforesaid facts, this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Begusarai/concerned Court below in connection with Birpur P.S. Case No. 179 of 2024.
