Petitioner is in jail custody since 08.01.2014 in a case registered for the offences punishable under Sections 20/22 of Narcotics Drugs and Psychotropic Substance Act. According to the prosecution case itself, the alleged recovery of Charas was made from the conscious possession of co-accused Noor Alam and so far as petitioner is concerned, it is only stated that one Lava mobile phone was recovered from his conscious possession. Petitioner does not have any criminal antecedent.

Considering the aforesaid facts and circumstances as well as

Patna High Court Cr.Misc. No.53170 of 2015 (2) dt.24-11-2015 P2/2 submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of 1st Additional Sessions Judge-cum-Special judge, Motihari in connection with Motihari Town P.S. Case No. 07/2014.
