JUSTICE ASHUTOSH KUMAR ORAL ORDER 10-06-2020 Heard Mr. Gopal Kumar Jha, learned counsel for the petitioner and learned APP for the State. The petitioner, who is a person of clean antecedent, seeks bail in anticipation of his arrest in connection with Special Case No. 149 of 2019 arising out of Jokihat P.S. Case No. 51 of 2019, dated 27.01.2019, instituted for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Patna High Court CR. MISC. No.7678 of 2020(2) dt.10-06-2020 2/3 It appears from the records that 17.5 litres of liquor was recovered from a motorcycle belonging to the petitioner. From near the motorcycle, two persons were arrested, viz., Balram Kumar and Manjit Kumar. One person, viz., Sanjay Mahto managed to flee away. The arrested accused persons disclosed that the motorcycle belongs to the petitioner.
The petitioner admits that the motorcycle belongs to him, but he had given it to aforesaid Balram Kumar and Manjit Kumar for fetching medicines from the market. They misused the aforesaid act of generosity of the petitioner. Considering the facts aforestated, the petitioner above named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned 2nd Addl. District and Sessions Judge-Cum-Special Judge, Araria in connection with Special Case No. 149 of 2019 arising out of Jokihat P.S. Case No. 51 of 2019,
