Petitioner apprehends arrest in a case registered for the offence punishable under Section 30 (a) (c) of the Bihar Prohibition and Excise Act-2018.

Prosecution case is that 8 liters country made liquor, has been recovered.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner.

Learned counsel for the state submits that the petitioner has got two criminal antecedent of

Patna High Court CR. MISC. No.10564 of 2023(2) dt.27-04-2023 2/2 similar nature.

Considering the facts of the case as also the fact that petitioner has got two criminal antecedent of similar nature, prayer for anticipatory bail is rejected.
