JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 05-07-2019 After some argument, learned counsel for the petitioner realized that in fact the petitioner is looking to challenge the auction sale itself because the relief prayed in the writ application may be granted by an appropriate forum only when the circumstances exist to interfere with the auction sale, learned counsel for the petitioner has sought to withdraw this writ application with liberty to seek his remedy under the Securitisation and Reconstruction of Financial Assets and Enforcement of Securities Interest Act, 2002 itself before the appropriate court/forum in accordance with law. The writ application is permitted to be withdrawn with the liberty as prayed for.

If an appropriate application is filed by the petitioner

Patna High Court CWJC No.3819 of 2019(2) dt.05-07-2019 2/2 before the Debts Recovery Tribunal and a question of limitation arises for consideration, the same will be considered keeping in mind that the petitioner was pursuing his remedy before this Court since 20.02.2019.
