03-12-2015 Heard Sri Krishna Prasad Singh, learned senior counsel, who was assisted by Sri Bhashkar Shankar, learned counsel for the petitioner and Sri Damodar Prasad Tiwary, learned Addl. Public Prosecutor.

The petitioner, who is in custody since 06-07-2015 in Imamganj P.S. Case No. 35 of 2015 registered for the offence under Sections 302, 201, 34 of the Indian Penal Code and sections 3⁄4 of the Prevention of Witch Practices Act, 1999, has prayed for grant of bail.

It was submitted by learned senior counsel for the petitioner that though in the F.I.R., the petitioner has been named as accused, but only on suspicion, since about 10 to 12 days ago, the petitioner had used a word "Witch" against the mother of the

Patna High Court Cr.Misc. No.52262 of 2015 (2) dt.03-12-2015 2/2 informant.

In view of nature of accusation against the petitioner, let the petitioner namely Ramjee Mistry @ Ramji Mistri be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Abhay Srivastava, learned Judicial Magistrate 1st Class, Sherghati (Gaya)/concerned court in connection with Imamganj P.S. Case No. 35 of 2015.
