This application has been filed for cancellation of bail of Opposite Party No.2 granted by order dated 07.12.2018 passed in Cr. Misc. No.72530 of 2018 in connection with Complaint Case No.144 of 2017 to the satisfaction of the Sub Divisional Judicial Magistrate, Sherghati, Gaya. Counsel for the petitioner submits that in the agreement, which has been enclosed as Annexure- 3, it is mentioned that rupees four lac has been given to the Opposite Party No.2 in cash.

It appears that this Court after considering the fact that no amount was credited in the account of Opposite Party

Patna High Court CR. MISC. No.10933 of 2019(2) dt.27-02-2019 2/2 No.2 by RTGS has granted bail to the Opposite Party No.2. Counsel for the petitioner is unable to show that any amount has been transferred in the account of the Opposite Party No.2 through RTGS. As such, there is no concealment of any fact at the time of grant of bail to Opposite Party No.2. There is no merit in this application.

This application is, accordingly, dismissed.
