The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 448, 341, 323, 324, 307, 379 & 504/34 of the Indian Penal Code. All the F.I.R. named accused persons including these petitioners in furtherance of their common intention armed with deadly weapons are said to have entered into the house of the informant and assaulted his family members.

Patna High Court CR. MISC. No.10253 of 2023(2) dt.09-05-2023 2/3 It is submitted by learned counsel for the petitioners that no such occurrence as alleged ever took place. Petitioners have been falsely implicated in this case. As a matter of fact, both the parties are agnates and there was some prevailing neighbour's dispute between the parties. A free fight happened between the parties on account of garbage disposal issue on the said day. The allegation levelled against the petitioners is not specific rather general and omnibus in nature. This case is a counterblast of the case of the petitioners' side bearing Lakhisarai (Ramgarh Chowk) P.S. Case No.583 of 2022. It is further submitted that in the aforesaid occurrence both sides have sustained injuries and the injuries are simple in nature. Petitioner no.1 has one criminal antecedent, whereas petitioner nos.2, 3 & 4 have no criminal antecedent as mentioned in para-3 of this application.

Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned lower Court where the case is pending/successor Court in
