Earlier the prayer for bail of the petitioner was rejected by this Court, vide order dated 13.4.2017 passed in Cr. Misc. No.17119 of 2017.

There is allegation of commission of rape on the informant, who is minor.

Submission of the learned counsel for the petitioner is that he is in custody for more than 2 1⁄2 years and up till now only four witnesses have been examined and the Doctor and the I.O. have not been examined. .

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, since the petitioner is in custody

Patna High Court CR. MISC. No.14336 of 2019(3) dt.04-04-2019 2/2 for more than 2 1⁄2 years, the learned trial court is directed to expedite the trial and try to conclude it as soon as possible. At the same time, the Sr.S.P., Gaya is also directed to produce the I.O. and the Doctor on the date fixed in the learned trial court so that the trial may be concluded. With the aforesaid direction, this application is dismissed.
