This is third attempt made on behalf of the petitioner for the grant of regular bail. Earlier prayer was refused twice vide order dated 20.02.2013 and 16.07.2014 respectively passed in Cr. Misc. Nos. 43851/2012 and 52955/2013 in connection with NCB/NDPS Case No. 65/2012 pending before learned 1st Additional Sessions Judge, East Champaran at Motihari.
By filing counter affidavit it is stated that prosecution evidence have already been closed and matter is fixed for recording statement of accused persons under Section 313 of the Code of Criminal Procedure and case is posted for the same on 14th

Learned counsel for the petitioner expresses that he has no knowledge about arrival of such stage. However, if the statement made in the counter affidavit is true, prayer is refused with a direction to the court below to do the needfuls at the earliest and conclude the trial without avoiding any undue delay. In the event, statement is not correct trial court is directed to submit its report.
