Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State through video conferencing.

Petitioner is in jail custody since 30.01.2018 in connection with Sessions Trial No. 244 of 2018 arising out of Piro P.S. Case No. 19 of 2018 registered for the offences punishable under Sections 302/34 of the Indian Penal Code and 27 of the Arms Act.

Earlier the bail prayer of the petitioner was rejected by this court vide order dated 04.12.2018 passed in Cr. Misc. No. 64549 of 2018 but submission on behalf of the petitioner is that all the prosecution witnesses have already been examined and

Patna High Court CR. MISC. No.20963 of 2020(2) dt.10-09-2020 2/2 the case of the petitioner is lying before the trial court since long without any progress.

Petitioner happens to be assailant and, therefore, I do not feel it proper to release the petitioner on bail and accordingly, his prayer for bail stands rejected. However, taking note of submission advanced on behalf of the petitioner, the learned trial court is directed to dispose of Sessions Trial No. 244 of 2018 arising out of Piro P.S. Case No. 19 of 2018 within a month from the date when the court starts normal functioning.
