In this case, the petitioner is seeking bail in connection with Dariyapur P.S. Case No. 163 of 2013 registered for offences under sections 341, 448, 323, 307, 325, 379, 504, 34 of the Indian Penal Code and later on, Section 302 IPC was added. Allegation made in the first information report is that the father of information had gone to bring back his cattle which were grazing the field of the petitioner. Allegation has been made that all the accused persons have surrounded and assaulted the victim mercilessly who ultimately died.

The counsel for the petitioner submits that the petitioner has been shown to be an order giver and there is an

Patna High Court Cr.Misc. No.51421 of 2014 (3) dt.03-03-2015 2/2 allegation has been made against Ranjit Sah whose bail has been rejected but one Ram Lal Sah has been granted bail in Cr. Misc. No. 12967 of 2014.

Looking to the nature of allegation made against the petitioner, let the petitioner, above named, be released on bail on his furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran in connection with Dariyapur P.S. Case No. 163 of 2013.
